Gearbox breather - leak

I think I have a leak from my gearbox breather pipe ?

I am assuming that the black rubber pipe, coming from the gearbox area, wedged between my battery and air filter which is hooked at the top end with a hole in it is my breather pipe.

Is there any reason this pipe should leak oil given that there is no surplus in the gearbox and the pipe is propped up vertically ?

if the seals between you transfere and gearbox bypass oil can migrate between the two

Also check its not blocked or overfilled too.
